1. Acceptance of Terms

By accessing or using Werkset ("the Service"), operated at werkset.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Werkset is a portfolio platform that allows creative professionals to showcase their work, including videos, photos, audio, and project information. The Service includes features such as:

  • Creating and hosting portfolio pages
  • Uploading and displaying media content
  • Adding collaborator credits to projects
  • Contact forms for receiving inquiries
  • Analytics on portfolio views

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Content

Ownership

You retain all ownership rights to the content you upload to the Service ("User Content"). By uploading content, you grant Werkset a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content solely for the purpose of operating the Service.

Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and share the content
  • Your content does not infringe any third party's intellectual property rights
  • Your content does not violate any applicable laws
  • You have obtained necessary permissions from any individuals depicted in your content

5. Acceptable Use

You agree not to use the Service to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity
  • Upload content that infringes any patent, trademark, copyright, or other proprietary rights
  • Upload viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal purpose
  • Harvest or collect user information without consent
  • Use automated systems to access the Service without permission

6. Collaborations

The Service allows you to credit collaborators on your projects. By inviting a collaborator:

  • You represent that you have a legitimate professional relationship with the person
  • The collaborator must accept the invitation for the credit to appear linked
  • Either party may remove the collaboration at any time

7. Premium Features

Some features of the Service may require a paid subscription ("Premium"). By subscribing to Premium:

  • You agree to pay the applicable fees
  • Subscriptions automatically renew unless cancelled
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days notice

8. Intellectual Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by Werkset and protected by international copyright, trademark, and other intellectual property laws.

The Werkset name, logo, and all related names, logos, and slogans are trademarks of Werkset. You may not use these marks without our prior written permission.

9. DMCA and Copyright

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a notice to our designated agent including:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WERKSET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE PAST TWELVE MONTHS.

12. Indemnification

You agree to indemnify and hold harmless Werkset, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time through the account settings. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Werkset regarding the Service and supersede any prior agreements.
